Acceptable Use Policy

Please read these terms carefully before using Connectedliving.com. MyWay Village, Inc. provides this service to you and this Acceptable Use Policy (“AUP” or “Agreement”) applies to this service. By accessing and using this service you indicate your acknowledgment and acceptance of this Acceptable Use Policy. This AUP governs the use of this service and are subject to change without notice and bind you if you continue to use this Site. Therefore, if you are a regular Member of this service, please review this Acceptable Use Policy regularly.

If you do not agree with any portion of this Acceptable Use Policy, do not access or otherwise use this service or any information or content contained on the Connectedliving.com website. Your access to, registration on, and use of this service constitutes your agreement to abide by each term and condition of the Acceptable Use Policy set forth below.

Registration

By registering with MyWay Village, Inc., you agree to provide accurate, current and complete information about yourself, and to update that information if it changes; if you don't, we have the right to terminate your Connectedliving.com membership, any pages you have created and prevent you from using our service.

By completing the registration process, you are stating that you are at least 13 years old, and that you agree to this Acceptable Use Policy. MyWay Village, Inc. reserves the right to deny access to children under the age of 13 in order to comply with our privacy regulations.

As part of the Connectedliving.com registration process, you will choose a user name and password. It is your responsibility to keep this password confidential. If you discover that someone is using your password or account without your consent, or you discover any other breach of security, you agree to notify us immediately at privacy@connectedliving.com. You are solely responsible for any and all use of your account.

The membership is for a one year term, or other term as described in your Customer agreement, but can be cancelled by calling our customer service number. If the membership is not cancelled within the first year, it will automatically renew for the same term unless you opt out by calling our customer service number.

Member Conduct

You agree that you will not:1. Transmit through Connectedliving.com any unlawful, harassing, abusive, threatening, harmful, obscene, defamatory, libelous, tortuous, or otherwise objectionable content; 2. Copy, broadcast, distribute, or otherwise use any content provided by others, in a manner that is unlawful, harassing, abusive, threatening, harmful, obscene, libelous, tortuous, or otherwise objectionable; 3. Transmit any content that might infringe the intellectual property rights, privacy rights, rights of publicity, or other proprietary rights of others; 4. Collect information about others without their consent; 5. Harvest e-mail addresses for the purpose of mass mailing Members or post information with the intent to market and solicit for unauthorized advertising, products, and/or services; 6. Reveal personally identifiable information about children; 7. Interfere with or disrupt this MyWay Village, Inc.’s services, computer systems, servers or networks, or violate the regulations or policies of such networks; 8. Transmit any content containing viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful programs; 9. Attempt to gain unauthorized access Connectedliving.com site or services, others' accounts or computer systems or networks connected to this site, through password mining or otherwise; 10. Engage in any systematic extraction of data or data fields, including without limitation e-mail addresses; 11. Provide false information on your registration form, impersonate any person or the voice of any person, or otherwise attempt to mislead others about your identity or the origin of a message or other communication; 12. Transmit junk mail, spam, chain letters, or other unsolicited bulk e-mail or duplicative messages; 13. Sell access to or use of any services available through Connectedliving.com site or service; 14. Interfere with anyone's use or enjoyment of this Connectedliving.com site and/or service; You will report any offensive or otherwise inappropriate content or behavior to privacy@connectedliving.com

Confidentiality of User Communications

Except as required by law and in accordance with the Connectedliving.com Privacy Policy, MyWay Village, Inc. will use commercially reasonable methods to maintain the confidentiality of all Member communications which contain personal Member information and which are transmitted directly to Connectedliving.com (Site). For Site administration purposes, this Site may need to view personally identifiable information. Only employees of MyWay Village, Inc. may view this information for the express purpose to improve the functionality of this Site and the individual Connectedliving.com account. In addition, MyWay Village, Inc. reserves the right to monitor your content for adherence to our Acceptable Use Policy and to report violations, and the substance of those violations including personally identifiable Member information and Member communications, to law enforcement personnel and MyWay Village, Inc. partners or affiliates.

Members should be aware that third-party linked sites might contain confidentiality provisions that differ from the provisions provided herein. MyWay Village, Inc. is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions. MyWay Village, Inc. does not knowingly collect personal information regarding children.

Communications from MyWay Village, Inc.

By using this service, you agree to receive communications from MyWay Village, Inc and Connectedliving.com that are necessary to the use of the service. Examples of these communications include, but are not limited to, welcome notices, service notices, educational e-mails and e-mails regarding any changes to the service. A convenient link or instructions will be provided on such e-mails for recipients to remove themselves from these communications.

Copyright/Trademarks

This Site, including images, text, audio and other components therein ("Materials") are copyrighted materials owned by MyWay Village, Inc. or its Partners and Affiliates and protected by worldwide copyright laws and treaty provisions. Elements of this site are also protected by copyright, trademarks, trade dress and other laws and may not be copied or imitated in whole or in part. Materials and elements, including, but not limited to, names, trademarks, logos, graphics, sounds or images may not be used, copied, reproduced, modified, published, uploaded, posted, transmitted, or distributed, in any way without MyWay Village, Inc.'s express prior written permission. Except as expressly provided herein, neither MyWay Village, Inc. nor its Partners and Affiliates grant any express or implied right to Members under any patents, copyright, trademarks, or trade secrets.

This Site does not claim any ownership in any photographs, images, video, works of authorship, or other materials (“Submission”) submitted by you. You represent and warrant that all Submissions you provide to Mywayvillage.com are exclusively owned by you and do not infringe on any person’s intellectual property rights (including, but not limited to copyrights, trademarks, service marks, or any other proprietary, publicity, or privacy rights).

Updates and Errors

Neither MyWay Village, Inc. nor its Partners and Affiliates warrant the accuracy or completeness of the information, text, graphics, links, or other items contained within this Site. The documents and related graphics published on this Site could contain technical inaccuracies or typographical errors. Changes are periodically made to the information herein. MyWay Village, Inc. or their respective suppliers, Partners, and Affiliates may make improvements and/or make changes in the product(s) and/or the program(s) described herein at any time.

Limitation on liability includes, but is not limited to, the transmission of any viruses which may infect a your equipment, failure of mechanical or electronic equipment or communication lines, telephone or other interconnect problems (e.g., you cannot access your Internet service provider), unauthorized access, theft, operator errors, strikes or other labor problems or any force majeure. Furthermore, you agree to indemnify MyWay Village, Inc. and its Partners and Affiliates against liability for any and all use of the Site.

Although MyWay Village, Inc. will attempt to address any problems or concerns regarding its service, if you continue to be dissatisfied with this Site or services or the content available thereon, or with any of this Acceptable Use Policy, your only remedy is to discontinue using Connectedliving.com.

Limitation of Liability for Services Provided by Sponsored Retirement Facilities.

You understand that Connectedliving.com may provide you with information about other businesses that provide their own goods or services. MyWay Village, Inc. and its Partners and Affiliates, any of their officers, directors, employees, agents, or information providers hereby disclaim any liability, whether in contract, tort, strict liability or otherwise, for any indirect, punitive, special, consequential or incidental damages (including without limitation lost profits, cost of procuring substitute service or lost opportunity) arising out of or in connection with the goods or services provided by any third party identified on this Site, including without limitation, liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligent or otherwise, of such dealers and you hereby exonerate MyWay Village, Inc. and its Partners and Affiliates from any liability with respect to the same.

Jurisdiction and Venue

This Site is controlled and operated by MyWay Village, Inc. from its offices within the United States of America. Any claim relating to this Site shall be governed by the internal substantive laws of the state of Massachusetts. You and MyWay Village, Inc. agree to submit to the personal and exclusive jurisdiction of the courts located within the state of Massachusetts. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this Site or this Acceptable Use Policy must be filed within one (1) year after such claim or cause of action arose.

Linked Internet Sites

MyWay Village, Inc. prohibits caching, unauthorized hypertext links to this Site and the framing of any materials available through this Site. The unauthorized sale of products or services and related payment hypertext links are prohibited on this Site. MyWay Village, Inc. reserves the right to disable any unauthorized links or frames and specifically disclaims any responsibility for the contents of any other Internet sites linked to this Site. Access to any other Internet sites linked to this Site is at the Members’ own risk. Members should be aware that linked sites may contain rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions that differ from the provisions provided on this Site. MyWay Village, Inc. is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions.

Violation of Terms and Conditions

MyWay Village, Inc. reserves the right to seek all remedies available at law and in equity for violations of this Acceptable Use Policy, including the right to block access from a particular Internet address to this Site. MyWay Village, Inc. operates this Site and reserves the right to change this Acceptable Use Policy at any time and from time to time without notice. The failure of MyWay Village, Inc. to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. The section titles herein are for convenience only and have no legal or contractual effect.

Entire Agreement

This Acceptable Use Policy, the Privacy Policy and the Customer Agreement constitute the entire Agreement between MyWay Village, Inc. and you in connection with your use of this service, any products or services offered. MyWay Village, Inc. may update this Acceptable Use Policy from time to time by posting revised terms and conditions on the website, without notice to you, and your subsequent use of this service is governed by the new Acceptable Use Policy. This Acceptable Use Policy is effective until terminated by MyWay Village, Inc.. In the event of termination, the Proprietary Rights, Disclaimers, Limitations of Liabilities, and Governing Law provisions set forth in this Acceptable Use Policy will survive. In the event of a conflict between any other notice, policy, disclaimer or other term contained in this Site, this Acceptable Use Policy will control. If any provision is deemed to be unlawful or unenforceable, it will not affect the validity and enforceability of the remaining provisions.
